These Terms of Service ("Terms") govern your access to and use of the MyBoracayGuide website and booking marketplace (the "Service"), operated in Boracay, Malay, Aklan, Philippines. By creating an account, sending an inquiry, or booking a property through the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. What MyBoracayGuide Is
MyBoracayGuide is an online travel marketplace that connects guests with independently owned and operated hotels, resorts, villas, and other accommodations ("Properties") in Boracay. We are not the owner or operator of the Properties listed on the Service โ each Property is managed by its own partner ("Partner"), who is responsible for the accuracy of their listing, availability, pricing, and the stay itself. MyBoracayGuide facilitates inquiries, bookings, and payments between guests and Partners.
2. Accounts
You must provide accurate and complete information when creating an account and keep your login credentials confidential. You are responsible for all activity that occurs under your account. Partner accounts are additionally subject to our identity verification (KYC) process before a listing can be published โ see our Property Verification workflow in the Partner Portal for details.
3. Inquiries, Bookings & Payments
Sending an inquiry through a property page is a request for availability and does not guarantee a booking. Once a booking is confirmed, payment may be made by bank transfer (with proof of payment uploaded for verification) or by card/e-wallet through our payment processor. All prices are shown in Philippine Peso (โฑ) and are inclusive of taxes unless stated otherwise. Cancellation and refund terms are set individually by each Property and are shown on the Property's detail page โ please review them before booking.
4. Partner Listings & Responsibilities
Partners are solely responsible for the accuracy of their listing content (photos, descriptions, amenities, pricing, and availability) and for honoring confirmed bookings. Listings marked "Verified" have had their ownership/authorization documents reviewed by our team; this does not constitute a guarantee of the stay itself. We reserve the right to remove any listing, suspend, or terminate a Partner account that violates these Terms, provides misleading information, or receives credible complaints of misconduct.
5. Acceptable Use
You agree not to: use the Service for any unlawful purpose; submit false, misleading, or fraudulent information; attempt to circumvent our booking or payment process to avoid service fees; scrape, copy, or resell Service content without permission; or interfere with the security or normal operation of the Service.
6. Disclaimers & Limitation of Liability
The Service is provided "as is." We do not guarantee the accuracy, completeness, or availability of any listing, and we are not liable for the acts, errors, omissions, or conduct of any Partner or guest. To the fullest extent permitted by Philippine law, MyBoracayGuide's liability for any claim arising from your use of the Service is limited to the amount of service fees you paid to us for the booking giving rise to the claim.
7. Intellectual Property
The MyBoracayGuide name, logo, and website design are our property and may not be used without written permission. Photos and descriptions submitted by Partners remain licensed to us for display on the Service for as long as the listing is active.
8. Changes to These Terms
We may update these Terms from time to time. We will update the "Last updated" date above when we do. Continued use of the Service after a change means you accept the revised Terms.
9. Governing Law
These Terms are governed by the laws of the Republic of the Philippines. Any dispute arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Aklan, Philippines.
